NOTICE OF PUBLIC HEARING

Notice is hereby given that I, Clay Jones and Pamela Lynn Coffey-Jones, have as the owner of the property commonly described as the address on E. S.R. 42, Mooresville, IN 46158, Parcel No: 55-05-03-100-011.000-004, and legally described by the legal description below, have filed a petition before the Morgan County Plan Commission, which petition requests a Zone Map Change from Agriculture to Residential 1 for the said property in order to continue development of Pierce Minor Plat which will consist of 3 newly plated single-family homes.

Legal Description:

Part of the Northwest Quarter Section 3, Township 13 North, Range 1 East, Morgan County, Indiana, described as follows:

Commencing at the Harrison Survey Monument, found in State Road Number 42 which, per county surveyor’s records, marks the southeast corner of the Southwest Quarter of the Northwest Quarter of the above captioned Section 3 (for reference, the Harrison survey monument which marks the southwest corner of the Northwest Quarter is South 85 degrees 50 minutes 03 seconds West, 1353.31, feet based upon Indiana State Plane, West Zone Coordinate System – N.A.D. 1983, basis of bearings for this legal description); thence North no degrees 32 minutes 15 seconds West, with the east line of the West Half of the Northwest Quarter, 46.00 feet to an iron pin with cap engraved “Holloway Engr. – Firm 46” on the north right-of-way line of State Road 42, and the POINT OF BEGINNING the parcel herein described (for reference, a concrete right-of-way monument is South 85 degrees East, 7.8 feet); thence with the north right-of-way line of State Road 42 for the following two (2) courses; 1 ) North 84 degrees 14 minutes 24 seconds West,19.18 feet; 2) South 85 degrees 50 minutes 03 seconds West, 256.10 feet to an iron pin with cap engraved “Holloway Engr. – Firm 46”, thence North no degrees 32 minutes 15 seconds West, 1429.59 feet to an iron pin with cap engraved “Holloway Engr. – Firm 46”, thence North 86 degrees 48 minutes 08 seconds East, 274.95 feet to an iron pin with cap engraved “Holloway Engr.- Firm 46”, on the east line of the West Half of the Northwest Quarter; thence South no degrees 32 minutes 15 seconds East , with said east line, 1428.25 feet to the Point of Beginning.

Containing 9.0000 acres, no more or less, and subject to any rights-of-way, easements or restrictions of record or observable.

This Petition, File Z-25-01, Zone Map Change, will come for a hearing at 6:30 p.m. at the Morgan County Government Center on Monday, March 10, 2025. Information on this matter will be available for the public fifteen (15) days prior to said meeting, during regular working hours, at the Morgan County Planning Department, located at 180 South Main Street, Martinsville, Indiana. Interested persons appearing in favor of or in opposition to the petition will be heard thereon by the Board.

NOTICE OF PUBLIC HEARING

This is to inform you that the Morgan County Board of Zoning Appeals will hold a public hearing on Monday, February 24, 2025 at 6:30 pm in the Morgan County Administration Building located at 180 S. Main Street, Martinsville, Indiana to consider petition D-25-02.

This petition, submitted by Woodson Cheek, Jr, seeks approval to increase the maximum living area of an accessory dwelling unit. The property is located at 4724 N. Bowman Road in Ashland Township, Morgan County, Indiana and is more particularly described as follows:

NOTICE OF ANNUAL MEETING OF LAND OCCUPIERS

TO BE HELD FOR THE MORGAN COUNTY SOIL AND WATER CONSERVATION DISTRICT

To all occupiers of lands lying within the boundaries of the Morgan County Soil and Water Conservation District, notice is hereby given that on the 19th day of February 2025, beginning at 6:00 pm, an annual meeting will be held for the purpose of making a full and due report of their activities and financial affairs since the last annual meeting and to elect supervisors for the Morgan County Soil and Water Conservation District of the State of Indiana.

In case of hazardous roads that severely restrict travel, the meeting will be rescheduled for the 20th day of February, 2025. If in doubt, listen to local radio or call (765) 349-2060. All land occupiers and other interested parties are entitled and invited to attend. RSVP is required. Free to attend. Donations will be accepted for meal offered.

NOTICE TO BIDDERS 

MADISON TOWNSHIP OF MORGAN COUNTY, INDIANA

FIRE STATION 31 REMODEL PROJECT

Notice is hereby given that Madison Township of Morgan County, Indiana, a political subdivision (the “Township”) will receive sealed bids for the MADISON TOWNSHIP OF MORGAN COUNTY, INDIANA FIRE STATION 31 REMODEL PROJECT. Bids will be received at the Madison Township Trustee’s Office, 7047 E. Landersdale Rd., Camby, IN 46113, until 4:00 p.m. EST on or before, FEBRUARY 12, 2025 and as soon as practicable thereafter on the same date, the Bids will be publicly opened and read aloud in the Conference Room of the Township Offices. Any Bid received after the designated time will be returned to the Bidder unopened. The Bid should be clearly marked “BID ENCLOSED: FIRE STATION 31 REMODEL PROJECT” on the outside of the envelope, and as otherwise set forth in the Bid Documents.

In general, the work for the Project (the “Work”) Will consist of 3 phases. The first phase Modifying wall between living area and apparatus bays to be a fire wall and 3 steel doors that meets the Indiana state codes for commercial building. The second phase will consist of rewiring the living areas to meet Indiana codes and will require the removal of existing wiring and breaker box and be replaced with new wiring and breaker box that meets Indiana State code. This phase will also include any needed lighting replacement as well as emergency exit lights and emergency lighting. Phase 3 will be the removal of several interior walls, repair of drywall as needed, painting, carpet, trim, interior doors with solid core doors, and repairs to the mechanical room.at Station 31, located at, 10023 No. Kitchen Rd. Mooresville IN 46158. Bids may be for one phase of the project, two phases of the project or for all phases of the project all as set forth in the Bid Documents for the Project which are available at Madison Township Trustee’s Office, 7047 E. Landersdale Rd., Camby, IN 46113, or may be obtained digitally from Trustee Larry Ellis at lellis@mtfd.us.

Bidders shall assure that they have obtained complete sets of Bid Documents and shall assume the risk of any errors or omissions in bids prepared in reliance on incomplete sets of drawings and Bid Documents.

Bids must be submitted on the forms found in the Bid Documents, must contain the names of every person or company interested therein, and shall be accompanied by:

(1) Revised Form No. 96 as prescribed by the Indiana State Board of Accounts and as required in the Instruction to Bidders, including a financial statement, a statement of experience, a proposed plan or plans for performing the Work and the equipment the Bidder has available for the performance of the Work;

(2) Bid Bond in the amount of ten percent (10%) of the total Bid amount, including alternates with a satisfactory corporate surety or by a certified check in the amount of ten percent (10%) of the amount of the total Bid. The Bid Bond or certified check shall be evidence of good faith that the successful Bidder will execute within fifteen (15) calendar days from the acceptance of the Bid, the Agreement as included in the Bid Documents. The Bid Bond or certified check shall be made payable to the Township.

(3) A Non-Collusion Affidavit complying with the requirements of Ind. Code § 36-1-2-4.

Township reserves the right to hold any or all Bids for a period of not more than sixty (60) days after the date on which the Bids are opened and, for such sixty (60) day period, all such Bids shall be in full force and effect. Any Bid may be withdrawn prior to the scheduled closing time for the receipt of Bids but no Bidder shall withdraw a Bid within the sixty (60) day period after opening of the Bids. All bid security of unsuccessful bidders will be returned by the Township upon selection of the successful Bidder and execution of the Agreement, and provision of the required Performance Bond and Payment Bond.

In the event that the total amount of the contract awarded to the successful Contractor is $300,000 or more, the successful Contractor must be qualified under either Ind. Code § 4-13.6-4 or Ind. Code § 8-23-10 before doing any work on the Project.

Pursuant to Ind. Code § 5-22-17-6, Township reserves the right to specify in the contract with the successful bidder one or both of the following:

  1. Early performance of the contract will result in increased compensation;
  2. Completion of the contract after the termination or designated completion date(s) will result in a deduction from the compensation.

A Performance Bond and Payment Bond with good and sufficient surety, acceptable to the Township, shall be required in an amount equal to one hundred percent (100%) of the Contract Price, conditioned upon the faithful performance of the Agreement. The surety of the Bonds may not be released until one (1) year after the Township’s final settlement with the Contractor. Retainage will be as required by Ind. Code § 36-1-12 et seq.

All out-of-state entities must have a certificate of authority to do business in the State. Application forms may be obtained by contacting the Secretary of State, State of Indiana, Statehouse, Indianapolis, Indiana 46204.

Township reserves the right to (1) cancel this solicitation pursuant to Ind. Code § 5-22-18-2 and/or (2) reject any offers, in whole or in part as specified in the solicitation when Township determines in accordance with applicable Indiana laws including but not limited to Ind. Code § 36-1-12-4, that such action is in the best interests of the Township. Township reserves the right to delay the opening of the Bids pursuant to Ind. Code § 36-1-12-4. To the extent permitted by applicable law, the Township reserves the right to waive any of the terms, conditions or provisions contained in this Notice to Bidders or the Bid Documents or any informality, irregularity or omission in the bid process or in any Bid which waiver is deemed in the Township’s discretion to be to the advantage of the Township and which does not afford any Bidder a material competitive advantage over other Bidders. Except as specifically otherwise provided herein and as allowed by applicable Indiana law, a contract for the Project shall be awarded in accordance with this Notice to Bidders, Ind. Code § 5-16-13 et seq. and Ind. Code § 36-1-12 et seq., to the lowest responsible and responsive Bidder whose bid does not exceed the funds available for the Project. The Township shall have the right to accept any Alternates in any order or combination or accept on the basis of the Base Bid alone, unless otherwise specifically provided in the Bidding Documents and to determine the lowest responsible and responsive Bidder on the basis of the sum of the Base Bid and Alternates accepted.
